USER AGREEMENT FOR EYE HOME CLINIC II

Effective Date: May 18, 2025

This User Agreement (hereinafter referred to as "this Agreement") governs the use of the EYE HOME Clinic II app (hereinafter referred to as "this app") provided by GANA Holdings Inc. By using this app, the user agrees to be bound by the terms and conditions set forth below.

ARTICLE 1: PURPOSE

This Agreement outlines the rights, responsibilities, and obligations between this app and the user regarding the use of services provided by this app.

ARTICLE 2: DEFINITIONS

1. "User" refers to individuals who install and use this app.

2. "Service" refers to the functions and content provided through this app.

ARTICLE 3: ACCEPTANCE OF AGREEMENT

By downloading or using this app, the user is deemed to have agreed to all the terms in this Agreement, including the Privacy Policy and any other relevant policies.

ARTICLE 4: MODIFICATION OF AGREEMENT

This app reserves the right to revise this Agreement. Users will be notified of any changes via in-app announcements or website notices. Continued use of the app after such changes shall constitute acceptance of the revised Agreement.

ARTICLE 5: SERVICE DESCRIPTION

1. This app is a reference tool for anterior segment eye imaging and informational review.

2. This app does not provide medical diagnosis or treatment. All analysis results are non-diagnostic and intended for informational purposes only.

3. AI models assist in analyzing the image quality and identifying potential abnormalities. The results may be supplemented with ophthalmologist review, which is also non-diagnostic.

4. Photos must be taken using supported iPhone models (iPhone 12 or later). iPads are not supported.

5. This app provides guidance to help users capture appropriate anterior segment photographs using the rear camera.

6. AI-generated feedback and medical input, if available, are provided for educational and informational purposes.

7. Photos and information submitted through this app may be reviewed by ophthalmologists and/or processed through AI models. However, this app is not a substitute for professional medical consultation.

8. Users can access results through ads or an optional subscription.

9. With user consent, certain anonymized data may be used for scientific research, system improvement, and algorithm validation. Users can opt out through in-app settings.

ARTICLE 6: SUBSCRIPTION AND FEES

1. Subscription is optional and provides access to analysis results without advertisements and up to 20 analysis requests per month.

2. The monthly subscription fee is $2.99 and is auto-renewable unless cancelled at least 24 hours before the end of the current billing cycle.

3. Subscription can be managed through the App Store account settings.

ARTICLE 7: USER RESPONSIBILITIES

1. Users shall not upload illegal, abusive, or inappropriate content.

2. Users are responsible for securing their login credentials.

3. Users shall not misuse the service or attempt unauthorized access.

ARTICLE 8: LIMITATION OF LIABILITY

1. This app is provided "as is" without warranties of any kind.

2. The provider shall not be liable for any damages resulting from the use or inability to use the service unless due to intentional misconduct or gross negligence.

3. Users are solely responsible for any medical decisions made based on the apps content.

ARTICLE 9: PRIVACY

Please refer to the Privacy Policy for details regarding data collection, usage, and protection.

ARTICLE 10: TERMINATION

1. Users may terminate use at any time by deleting the app.

2. The provider reserves the right to suspend or terminate service to users who violate this Agreement.

ARTICLE 11: INTELLECTUAL PROPERTY

1. All content, including images, software, and text, is owned by GANA Holdings Inc. or its licensors.

2. Any data used for research will be anonymized and never used for commercial purposes without the user's separate consent.

ARTICLE 12: GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Korea.
